How to legally invoice with your blog

Many blogs have gone from being mere entertainment to becoming a way of life. Blogging has started to generate income , and this always raises the same question: how can I invoice with a blog? What do I have to do to make everything legal?

Maybe you've taken a stroll around the Internet and have come back with more questions than answers. It often happens, there are many contradictory opinions in the field of invoicing. But don't worry, here we are going to resolve all your concerns: it turns out that invoicing for blogging is much simpler than you think.

The first thing you have to do is register as self-employed. From now on, you are working for yourself. But how can I register as self-employed?
There are two basic steps you must follow: first, you register with the Treasury to tell the State that you are going to generate business with your blog. Likewise, to be registered with Social Security as a self-employed person you must submit form TA.0521, which we also link to here. Remember that you will have to pay the corresponding membership fee each month. The first year of registration you will have the famous flat rate of 50 euros per month. Once you have submitted these two forms and have regularised your tax situation, remember that the invoices issued must include the IRPF and VAT.

But what if I want to invoice without registering with Social Security? It depends on how habitual the invoicing is. The legislation requires being registered if the profit-making activity is “habitual, personal and direct”, but the consideration of habitual is subject to interpretation. Is 8 hours a day a habitual activity? Of course. Is two hours a week a habitual activity? It depends on who.



In any case, there is a Supreme Court ruling on this concept which states that it is not necessary to be registered as self-employed with income below the Minimum Interprofessional Salary. This ruling sets a precedent, but there is no regulation on the matter. In other words: in the end it is the Social Security itself that interprets this regulation.

What if I don't want to register with the Tax Office?
Don't do it; it doesn't make sense. The Treasury requires you to declare your income and file VAT and IRPF returns. If you don't earn anything, you don't lose anything either. On the other hand, you should know that since 2015 the data from the Treasury and Social Security have been cross-checked. If you register with the Treasury but 30 days go by without registering with Social Security, the latter body will penalize you, considering that you have been carrying out an economic activity without having been registered as self-employed.
